Purposes of Processing

Railtraxx NV collects and processes customers’ personal data for customer and order management (including customer administration, tracking orders/deliveries, invoicing, monitoring creditworthiness, profiling, and sending marketing and personalized advertising).

 


Legal basis(es) for processing

Personal data is processed on the basis of Article 6.1 of the GDPR, specifically on the grounds of Railtraxx NV’s legitimate interest in operating its business and managing its commercial relationships.

Role of Railtraxx NV as Data Controller

Railtraxx NV acts as the data controller for the processing operations described above. In that capacity, Railtraxx NV provides data subjects with all required information in accordance with Articles 13 and 14 of the GDPR, handles communications from data subjects as required by Articles 15, 22, and 34 of the GDPR, and complies with all other obligations applicable to data controllers. Transfer to third parties

If necessary to achieve the stated purposes, the customer’s personal data will be shared with other companies within the European Economic Area that are directly or indirectly affiliated with Railtraxx NV, or with any other partner. Railtraxx NV guarantees that these recipients will take the necessary technical and organizational measures to protect the personal data. When a third party acts as a processor on behalf of Railtraxx NV, it will process the personal data exclusively for the agreed purposes and in accordance with Railtraxx NV’s instructions, and will implement appropriate technical and organizational security measures.

 

Retention Period

Personal data processed for customer management purposes will be retained for the period necessary to comply with legal requirements (including those related to accounting).

 


Right of access, rectification, erasure, restriction, objection, and data portability

The customer has the right to access their personal data at any time and may correct it (or have it corrected) if it is inaccurate or incomplete, have it erased, have its processing restricted, and object to the processing based on Article 6(1)(e) or (f) of the GDPR, including profiling based on those provisions. In addition, the customer has the right to obtain a copy (in a structured, commonly used, and machine-readable format) of their personal data and to have it transferred to another company. Direct Marketing

The customer has the right to object, free of charge, to any processing of their personal data for the purposes of direct marketing.
